These Terms govern browsing, using and contacting us through the Highview website. Separate terms and individual agreements govern paid travel, accommodation, connectivity and other services.

 

01  Scope and Purpose

These Website Terms of Use (the “Terms”) govern access to and use of the official website operated by Highview Inc. (the “Company”, “Highview”, “we”, “us”), available at https://www.highview.co.jp/, including the information and features we make available on that website (the “Site”).

Third-party websites, external booking platforms, payment services and other services not operated by us are subject to their respective providers’ terms. Where separate terms or agreements apply to a particular Highview service, those terms govern that service.

 

02  Separate Terms for Products and Services

Highview provides travel planning and arrangements, accommodation and venue services, transfers and concierge services, communications products (including 4Usim), sourcing and cross-border support, creative production, and event services. Bookings, contract formation, fees, payment, amendments, cancellation, refunds and allocation of responsibility for these services are governed by the applicable service terms, legally required disclosures, individual agreements, booking confirmations, checkout terms or other agreed documents.

Travel transactions are subject to applicable travel agency terms and disclosures under Japanese law. These Website Terms do not replace any such terms or waive any legally required pre-contract information or documentation.

 

03  Website Information, Quotations and Bookings

Unless expressly stated otherwise, photographs, sample itineraries, service descriptions, indicative prices, durations, vehicle and property descriptions, and availability information on the Site are for general reference. They may change due to timing, weather, transport conditions, provider requirements and other circumstances.

Accessing the Site, submitting an enquiry or requesting a quotation does not, by itself, create a confirmed reservation or paid service contract. The applicable booking process and service-specific conditions determine when a contract is formed.

 

04  Enquiries and Information You Submit

Please provide accurate and up-to-date information when submitting enquiries or quotation requests. We may ask for clarification or additional information reasonably necessary to respond. Unless separately agreed, we do not guarantee a particular response time or that we can accept a requested engagement.

Do not submit credit card details, passport copies, health information or other particularly sensitive information through a general contact form unless we have specifically instructed you to do so. Where such information is required, we will indicate an appropriate method for providing it.

 

05  Intellectual Property and Site Content

Text, photographs, videos, designs, graphics, logos, trademarks, software and other materials on the Site are protected by intellectual property rights owned by Highview or their respective rightsholders.

Except as permitted by applicable law, you must not reproduce, redistribute, modify, publicly transmit or commercially exploit such materials without the relevant rightsholder’s permission. Ordinary links to the Site are permitted if lawful and presented in a manner that does not falsely suggest our endorsement or partnership.

 

06  Materials Provided by Users

If you submit photographs, documents, logos, creative briefs or other materials to us, you must have the rights and permissions required to submit them and to allow us to review them for the purpose of your request.

We may use materials you submit as reasonably necessary to respond to an enquiry, prepare a proposal or quotation, assess or perform a requested engagement. Submission does not automatically transfer copyright or other intellectual property rights to us. We will not publicly use such materials in advertising or case studies without separate permission or another lawful basis.

 

07  Prohibited Conduct

When using the Site, you must not:

•  violate applicable law or third-party rights, impersonate others, or submit fraudulent requests;

•  gain unauthorized access, transmit malicious code, exploit vulnerabilities or interfere with the Site’s operation;

•  engage in unauthorized mass harvesting, excessive automated access or unsolicited solicitation; or

•  wrongfully damage the reputation of Highview or others, or disrupt other users’ lawful use of the Site.

 

08  Third-Party Links and Services

The Site may link to third-party booking services, maps, payment services, social media platforms and other websites. Such services have their own operators, terms and privacy practices.

Nothing in these Terms excludes responsibilities that Highview may have under applicable law or a separate agreement. However, we do not automatically guarantee the accuracy or continued availability of third-party information and services that we do not control.

 

09  Operation, Changes and Interruptions

We may update, suspend or restrict parts of the Site where reasonably necessary for maintenance, incident response, security, emergencies or other legitimate operational reasons. Where practicable, we will provide appropriate notice.

Changes or interruptions to the Site do not, by themselves, amend or extinguish our obligations under any separately concluded travel, accommodation, communications or other service agreement.

 

10  Responsibility and Liability

We endeavor to keep Site information accurate, complete and current. However, Site content is general information rather than an unconditional commitment for every individual transaction. Please confirm material terms before placing an order or making a booking.

Where loss arises from our intentional or negligent acts in operating or providing the Site, our liability will be determined in accordance with applicable law and any applicable individual agreement. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded under Japan’s Consumer Contract Act or other mandatory law.

 

11  Personal Information

We handle personal information collected through the Site in accordance with our Privacy Policy (https://www.highview.co.jp/privacypolicy) and applicable law. Please also refer to that policy for information about cookies and related technologies.

 

12  Changes to These Terms

We may revise these Terms for reasonable reasons, such as changes in law, Site functionality, security requirements or business operations. We will publish the updated Terms and their effective date on the Site or give notice by another appropriate method.

Any change to an existing individual service contract will be governed by that contract and applicable law, including relevant provisions of the Japanese Civil Code. Updating these Website Terms alone does not automatically change prices or cancellation conditions under existing service contracts.

 

13  Severability

If any provision of these Terms is found invalid or unenforceable under applicable law, the remaining provisions will continue in effect to the extent legally permitted and consistent with the purpose of these Terms.

 

14  Governing Law and Disputes

These Terms are interpreted under Japanese law. We encourage parties to attempt to resolve disputes relating to Site use in good faith before commencing proceedings. Any proceedings will be brought before a court having jurisdiction under applicable law.

Nothing in these Terms is intended to displace mandatory consumer protections, applicable rules of private international law or other non-excludable rights.

 

15  Language

These Terms are originally prepared in Japanese, and an English translation may be provided for convenience. If there is an inconsistency in interpretation, the Japanese version will be the reference text, without overriding mandatory legal rights or different terms expressly agreed under an individual contract.
